Terms of Service

The agreement between you and Hey Sini: what we do, what you agree to, the real risks of meeting people, and the limits of our responsibility. Plain-language summaries sit beside each clause.

Acceptance and eligibility

These Terms of Service are an agreement between you and Hey Sini. By creating an account or using the service you accept them and our Privacy Policy. If you do not agree, do not use Hey Sini.

You must be at least 18 years old and able to enter a binding contract. You agree to give accurate information and to keep your account secure.

What Hey Sini is (and is not)

Hey Sini is an introduction service. We match compatible members into a small table and may recommend a public venue, but we do not host, book, organise, supervise, or attend any dinner or meet-up, and we do not take payment on behalf of any venue. Whether, when and how you meet other members is entirely your own decision, made at your own discretion and risk.

Membership and dues

Parts of Hey Sini require a paid membership ("dues"). Prices are shown in the app for your city and are charged through our payment provider on a recurring basis until you cancel. You can cancel at any time from your account; cancellation stops future renewals and takes effect at the end of the current period. Founding-member terms, trials and any comped access are described where they are offered. If we charge you in error (for example a duplicate charge), or a table never forms for you, we will refund those dues, and we may refund in other cases at our discretion. Beyond those cases, dues already paid are not generally refundable, except where the law requires it, including your rights under the Australian Consumer Law.

We do not vet or background-check members

Hey Sini does not conduct criminal background checks or formal identity verification on its members. Our optional live-photo verification confirms only that a profile photo belongs to a real, live person at the time it was taken. A verification badge is not a guarantee of anyone's identity, character, conduct or safety. You are responsible for deciding who you meet and for taking sensible precautions.

Assumption of risk and release

You understand that interacting with and meeting other people, online and in person, carries inherent risks, and that Hey Sini does not control and is not responsible for the conduct of any member or other person. You assume all risk arising from your use of the service and from your interactions with other members.

To the fullest extent permitted by law, you release and discharge Hey Sini and its people from any claims, demands, losses, liabilities and damages of every kind, including personal injury, death and property damage, whether direct or indirect, that arise out of or in any way connect with your interactions with, or the conduct of, other members or third parties. You are solely responsible for your interactions with others.

Member conduct

You agree that you will not:

  • harass, threaten, abuse, defame, stalk or impersonate anyone;
  • post hateful, illegal, or sexually exploitative content;
  • solicit money from members, run scams, or send spam;
  • share another member's private information without consent; or
  • use Hey Sini for anything unlawful.

For your safety we strongly recommend you meet in a public place, tell someone you trust your plans, and stay sober enough to get yourself home.

Safety tools and emergencies

We provide tools to report and block members, and we may act on reports at our discretion, including removing content or accounts. These tools help, but they are not a substitute for your own judgement.

Hey Sini is not an emergency service and cannot respond to emergencies. If you or someone else is in immediate danger, contact your local emergency services: 000 in Australia, 112 in Indonesia.

Your content and the roll

You keep ownership of the content you create (messages, photos, your table's shared roll). You grant Hey Sini a non-exclusive, worldwide, royalty-free licence to host and display that content for the purpose of operating the service. You are responsible for what you post and confirm you have the right to share it. Photo features are designed to be captured live, and content shared with your table is intended to stay within it.

Verification

If you choose to verify, you take a live photo and may be asked to perform a simple action so we can tell a live person from a photo or screen. Verification is optional and, as noted above, is a signal of liveness only, never a guarantee about a person. How we handle the image is described in our Privacy Policy.

Acceptable use of the service

You agree not to:

  • copy, scrape, harvest, frame, mirror, resell or otherwise exploit any part of the service, its data, its design or its content, whether by automated means or otherwise;
  • reverse-engineer, decompile or attempt to derive our source code;
  • access the service other than through the interface we provide, or circumvent our access, rate-limit or security controls; or
  • introduce malware, overload our systems, or interfere with other members' use.

Our intellectual property

The Hey Sini name and brand, the website and app, their design, text, graphics and software, are owned by Hey Sini or its licensors and are protected by intellectual property laws. Your membership gives you a limited, personal, non-transferable right to use the service. It does not transfer any ownership, and nothing here grants you a right to use our name, branding or materials except as the service intends.

Disclaimers

To the fullest extent permitted by law, the service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the service will be uninterrupted or error-free, that matches or meetings will meet your expectations, or that any member is who they say they are. Nothing in these Terms excludes rights you have under consumer law that cannot lawfully be excluded (including under the Australian Consumer Law).

Limitation of liability

To the fullest extent permitted by law, Hey Sini and its people will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising from your use of (or inability to use) the service or your interactions with other members. Where liability cannot be excluded, our total liability to you is limited to the greater of the dues you paid us in the 12 months before the claim, or AUD 100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnity

You agree to indemnify and hold harmless Hey Sini and its people from any claims, losses, liabilities and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the service, or your conduct toward other members, to the extent permitted by law.

Suspension and termination

You may stop using Hey Sini and delete your account at any time. We may suspend or terminate access, remove content, or decline service if we reasonably believe you have breached these Terms, created a risk to others, or where required by law. Sections that by their nature should survive termination (including release, disclaimers, limitation of liability and indemnity) will survive.

Governing law and disputes

For members in Australia, these Terms are governed by the laws of Victoria, Australia, and you submit to the courts of that jurisdiction. We ask that you contact us first so we can try to resolve any issue informally.

The governing-law, dispute-resolution and language requirements for members in Indonesia (including any requirement for a Bahasa Indonesia version) are being finalised and will be updated.

Changes to these Terms

We may update these Terms from time to time. When we make material changes we will revise the date at the top and, where appropriate, notify you. Continuing to use Hey Sini after changes take effect means you accept the updated Terms.
